Point Topic Ltd — Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the websites, data

services, and application programming interfaces (including the public Model

Context Protocol endpoint) provided by Point Topic Ltd, a company registered

in England and Wales with registration number 03503830, whose registered

office is at International House, 36-38 Cornhill, London, EC3V 3NG, United

Kingdom ("Point Topic", "we", "us").

By accessing or using any Point Topic service, you agree to these Terms. If

you do not agree, do not use the services.

2. The services

2.1. Public data endpoint. We provide a free, publicly accessible

read-only endpoint ("Public Endpoint") exposing reference data about the UK

and international broadband market: the entity graph of ISPs, network

operators, networks, links and related reference information.

2.2. Licensed products. Our commercial data products (network footprints,

premises and speed data, coverage forecasts, take-up and subscriber

statistics, tariff pricing, and related datasets) are provided under separate

licence agreements. Access to licensed data requires a paid licence.

2.3. We may add, change, or remove features and data from the Public Endpoint

at any time, with or without notice.

3. Acceptable use

You must not, and must not permit others to:

use the Public Endpoint to access, attempt to access, or circumvent

restrictions on data that is not publicly available (including licensed

business data);

send excessive, abusive, or automated requests that impair the service for

others;

resell, redistribute, or incorporate Public Endpoint data into a competing

data service without our written permission;

use the services for any unlawful purpose or in violation of applicable

law, including data protection law;

attempt to disrupt, probe, scan, or test the vulnerability of the

infrastructure, or interfere with any user's use of the services.

4. Data and intellectual property

4.1. The Public Endpoint content, the ontology, the underlying databases, and

all related intellectual property rights belong to Point Topic or its

licensors. We grant you a limited, non-exclusive, non-transferable,

revocable right to access and use the Public Endpoint in accordance with

these Terms.

4.2. Reference data obtained from the Public Endpoint may be used for

internal analysis and research. Commercial redistribution requires our prior

written consent.

4.3. Nothing in these Terms transfers any ownership or licence rights other

than those expressly stated.

5. Privacy

Our collection and use of personal data is described in our Privacy Policy,

available at https://www.point-topic.com/privacy-policy/, which forms part of

these Terms.

6. Disclaimers

The services are provided "as is" and "as available", without warranties of

any kind, whether express or implied, including implied warranties of

merchantability, fitness for a particular purpose, accuracy, or

non-infringement. Data is provided for information purposes; while we work to

keep it accurate and current, we do not warrant that it is error-free,

complete, or timely, and it should not be relied upon as the sole basis for

decisions.

7. Limitation of liability

To the maximum extent permitted by law, Point Topic shall not be liable for

any indirect, incidental, special, consequential, or punitive damages, or for

any loss of profits, data, business, or goodwill, arising out of or in

connection with your use of the services. Our total aggregate liability under

these Terms shall not exceed the greater of (a) £100 or (b) the amounts paid

by you to us in the twelve months preceding the claim. Nothing in these Terms

limits liability that cannot be limited by law.

8. Changes to these Terms

We may revise these Terms from time to time. The latest version will always

be posted on this page, and the effective date will be shown at the top.

Continued use of the services after changes constitutes acceptance.

9. Termination

We may suspend or terminate your access to the Public Endpoint at any time,

including for violations of these Terms. Upon termination, your rights under

these Terms cease, and provisions that by their nature should survive

(including sections 4, 6, 7, and 10) will continue to apply.

10. Governing law

These Terms are governed by and interpreted in accordance with the laws of

England and Wales, and you submit to the exclusive jurisdiction of the courts

of England and Wales.
